Surtrix Privacy & Terms

These Terms of Use (the “Terms”) are a binding agreement between you and Surtrix (“Surtrix”, “we”, “us”, or “our”) governing your access to and use of the Surtrix website, applications, and related services (together, the “Service”).

By accessing or using the Service, or by clicking to accept these Terms, you agree to be bound by them and by our Privacy Policy. If you do not agree, do not access or use the Service.

You must be able to form a legally binding contract to use the Service. If you are a minor in your jurisdiction, you may use the Service only with the involvement and consent of a parent, guardian, or teacher who agrees to these Terms on your behalf and is responsible for your use. By using the Service, you represent that you meet these requirements.

Surtrix turns learning material you provide into playable browser games using an automated AI pipeline. We may add, change, or remove features, and we may suspend or discontinue all or part of the Service at any time. We may also set limits on usage, storage, or generation as needed to operate the Service reliably.

To use certain features you must create an account. You agree to provide accurate information and to keep it up to date. You are responsible for all activity that occurs under your account and for maintaining the confidentiality of your credentials, including any password or sign-in code. Notify us promptly at hello@surtrix.com if you suspect unauthorized use of your account.

You retain ownership of the learning material and other content you upload or create (“Your Content”). You grant Surtrix a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, display, and create derivative works from Your Content solely as needed to operate and provide the Service to you — including generating, storing, and running the games produced from it.

You represent and warrant that you own or have the necessary rights to Your Content and that it does not infringe or violate the rights of any third party or any applicable law. This license ends when you delete Your Content or your account, except for content already shared with others and for reasonable backup copies retained for a limited period.

You agree not to:

• Upload or generate content that is unlawful, infringing, defamatory, obscene, harmful, or that violates the rights of others;
• Use the Service to create content that exploits or endangers minors, promotes violence, or facilitates illegal activity;
• Attempt to reverse-engineer, decompile, scrape, or extract the Service’s source code, models, or underlying pipeline, except as permitted by law;
• Interfere with, disrupt, overload, or attempt to gain unauthorized access to the Service, its systems, or other users’ accounts;
• Circumvent usage limits, security measures, or access controls; or
• Use the Service to develop a competing product or in any way that violates these Terms or applicable law.

We may remove content or suspend access that we reasonably believe violates these Terms.

Games and other output are produced by automated AI systems and are provided “as is.” AI output may be inaccurate, incomplete, or unexpected, and may not be suitable for every purpose. You are responsible for reviewing and verifying any output before relying on, publishing, or sharing it, particularly for educational or assessment use.

Similar inputs may produce similar output for other users, and we make no guarantee that output is unique. As between you and Surtrix, and to the extent permitted by law, you may use the games generated from Your Content for your own lawful purposes consistent with these Terms.

The Service itself — including the Surtrix name, logo, brand, software, user interface, and generation pipeline — is owned by Surtrix and protected by intellectual property and other laws. These Terms grant you no right, title, or interest in the Service except the limited right to use it as expressly permitted. All rights not granted to you are reserved.

The Service relies on third-party providers, including Google Cloud, Google Gemini / Vertex AI, and email delivery services. Your use of the Service may also be subject to those providers’ terms. We are not responsible for third-party services and do not control their availability or performance.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or other users. Upon termination, your right to use the Service ends. Sections that by their nature should survive — including ownership, disclaimers, limitation of liability, and indemnification — will survive termination.

THE SERVICE AND ALL OUTPUT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or secure.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SURTRIX AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

You agree to indemnify and hold harmless Surtrix and its officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to Your Content, your use of the Service, or your violation of these Terms or applicable law.

These Terms are governed by the laws applicable in the jurisdiction in which Surtrix is established, without regard to conflict-of-law principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts of that jurisdiction, except where applicable law gives you the right to bring proceedings elsewhere.

We may update these Terms from time to time. When we make material changes, we will revise the “Last updated” date above and, where appropriate, provide additional notice. Your continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
